These Terms govern your use of kap-industries.com (the "Site") and your purchase of products from it. The Site is operated by SJP Media Limited, a New Zealand company trading as KAP Industries ("KAP", "we", "us"). By using the Site or placing an order you agree to these Terms.
1. Eligibility
You must be at least 18 and able to enter a binding contract to place an order.
2. Our products
KAP brackets are vehicle-specific mounting brackets for hand-held fire extinguishers. Each is designed for the exact make, model, generation and seat side stated on its product page. Confirm the bracket matches your vehicle, including model year, trim, seat type and side, before you buy. We are happy to help you check.
KAP brackets are designed for use only with a metal-strapped, cage-style vehicle extinguisher mount of the size stated on the product page. Where a product page carries model-specific installation notes, those notes override the general installation guide.
3. Orders, pricing and payment
Prices are in US dollars. Sales tax is calculated at checkout where applicable.
Payment is processed by our payment provider. We do not store your full card details.
Your order is accepted when we send the order confirmation. We may cancel and refund an order before it ships for pricing or stock errors, suspected fraud, or an address we cannot ship to.
If we find a pricing or product error after you order, we will contact you before shipping.
4. Shipping
Shipping terms and delivery estimates are in our Shipping Policy. Risk of loss passes to you on delivery to the address you provided.
5. Installation and safe use
Every KAP bracket ships with a safety sheet, and a general installation guide and video are on the Site. Read them, and any model-specific notes on the product page, before you start.
KAP brackets are designed for straightforward installation using standard hand tools. Because the bracket mounts using your vehicle's seat fasteners, which are safety-critical, you must follow the vehicle manufacturer's service procedure for those fasteners, including any replacement-bolt, threadlocker, tightening-sequence and torque requirements. KAP does not publish seat-bolt torque values. We recommend having the installation checked by a qualified automotive technician.
You agree to:
- Install the bracket only on the vehicle, seat and side it is designed for
- Follow the vehicle manufacturer's procedure for the seat fasteners
- Not drill, cut, bend, weld or otherwise modify the bracket or the vehicle
- Confirm after installation that the seat adjusts and locks securely, and that no seat belt, buckle, wiring or airbag component is contacted or obstructed. If seat travel is unexpectedly reduced, the seat binds or catches, or does not lock securely, do not drive
- Use only a suitable metal-strapped, cage-style vehicle extinguisher mount that is correctly sized, in good condition and installed per its manufacturer's instructions, attached to the bracket with the KAP-supplied hardware
- Never remove or use the extinguisher while the vehicle is moving. Stop safely and secure the vehicle first
To the extent permitted by law, KAP is not responsible for loss, damage or injury caused by installation that does not follow the supplied instructions or the vehicle manufacturer's procedures, by use with an unsuitable extinguisher or mount, or by modification of the bracket or vehicle.
6. Fitment Guarantee and returns
If a bracket does not fit the vehicle it was ordered for, arrives damaged or is defective, we put it right at no cost. Details are on our Refund policy page. Because every bracket is made for a specific vehicle, all sales are final for change of mind.
7. Limited Lifetime Warranty
KAP brackets carry a Limited Lifetime Warranty against defects in materials and workmanship for the original purchaser. Full terms, including exclusions, are in our Warranty & Fitment Guarantee. Your rights under applicable state law are not affected.
8. What our products are not
A KAP bracket holds a fire extinguisher securely and within reach. It does not prevent, detect or suppress fire and is not a fire suppression system.
KAP brackets are not approved or certified by DOT or NHTSA. No Federal Motor Vehicle Safety Standard establishes a specific approval or certification standard for aftermarket fire-extinguisher brackets. KAP makes no representation that a bracket satisfies the rules of any motorsport sanctioning body unless expressly stated in writing for a specific rule set. Installation must not interfere with seats, seat belts, airbags or other required safety systems. You are responsible for confirming that your extinguisher and its mounting meet any rules that apply to you. See Compliance and Claims.
9. Limitation of liability
To the extent permitted by law, KAP is not liable for indirect, incidental, special, consequential or punitive damages or lost profits arising from the Site or our products, and KAP's total liability for any claim relating to a product is limited to the amount you paid for it.
Nothing in these Terms limits or excludes liability for death or personal injury, for gross negligence or wilful misconduct, for any liability that cannot be excluded by law, or your rights under applicable consumer protection law. Some states do not allow certain limitations, in which case they apply only to the extent permitted.
10. Indemnity
You agree to indemnify KAP against third-party claims caused by your intentional misuse of a product, your unauthorized modification of a product or vehicle, or your unlawful use of a product.
11. Intellectual property
The Site, our bracket designs, product names, logos, photographs, videos and copy belong to KAP or our licensors. Do not copy, reproduce, reverse-engineer or commercially exploit them without written permission. Vehicle make and model names are trademarks of their manufacturers and are used for fitment identification only. KAP is not affiliated with or endorsed by any vehicle manufacturer.
12. Reviews and submitted content
If you submit a review, photo, video or comment, you grant KAP a perpetual, royalty-free, worldwide license to use and display it in connection with our business, and you confirm it is yours and does not infringe anyone's rights. We may decline or remove content. Install videos submitted by customers are published only after KAP technical review. Any incentive you received must be disclosed.
13. Acceptable use
Do not use the Site for any unlawful purpose, attempt unauthorized access, scrape data, place fraudulent orders or interfere with its operation.
14. Third-party links
We are not responsible for the content or policies of third-party sites we link to.
15. Dispute resolution and arbitration
Please read this section carefully. It affects your legal rights.
If you have a dispute with us, contact us first at help@kap-industries.com and give us 30 days to resolve it.
If we cannot, you and KAP agree that any dispute arising from these Terms, the Site or our products will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Either party may instead bring an individual claim in small claims court.
Class action waiver. Disputes will be brought only in an individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding.
Opt-out. You may opt out of arbitration by emailing help@kap-industries.com within 30 days of your first purchase, stating your name, order number and that you opt out.
16. Governing law
These Terms are governed by the laws of the State of Idaho and, for section 15, the Federal Arbitration Act. This does not deprive you of the protection of mandatory consumer protection laws of the state where you live.
17. Changes
We may update these Terms. The version in force when you order applies to that order.
18. General
If any part of these Terms is unenforceable, the rest remains in effect. These Terms, with our Privacy Policy, Shipping Policy, Returns and Replacements page and Limited Lifetime Warranty, are the entire agreement between you and KAP for the Site and your purchases.
